DESCRIPTION & BENEFITS OF A WILL...

It’s important that clients understand the benefits of a valid will and the risks of not having one. If the client has no will, then you should recommend they seek professional advice from a solicitor or will writing service. 

To make a valid will, two formalities must be followed: the will must be in writing and be properly executed. 

The minimum age for making a valid will under English law is 18. It should be a clear and unambiguous statement of the deceased’s wishes in respect of their estate and must be signed by the testator in the presence of two witnesses. 

The witnesses must not be beneficiaries of the will or the spouses of beneficiaries. If a beneficiary were to be a witness, they would not be able to inherit under the terms of the will. 

The terms of a will only take effect on the death of the testator. Before then, the testator can revoke or modify the will at any time. Modifications are recorded in a document known as a codicil. In the event of marriage, remarriage or entering into a civil partnership, a will is automatically revoked, unless specifically written in contemplation of the change of status.

The fellows stand or
Fall down on their knees.   

Then they swarm around me,
A hive of honey bees.   

I say,
It’s the fire in my eyes,   
And the flash of my teeth,   
The swing in my waist,   
And the joy in my feet.   

I’m a woman
Phenomenally.

Phenomenal woman,
That’s me.

Men themselves have wondered   
What they see in me.

They try so much
But they can’t touch
My inner mystery.

When I try to show them,   
They say they still can’t see.   

I say,
It’s in the arch of my back,   
The sun of my smile,
The ride of my breasts,
The grace of my style.

I’m a woman
Phenomenally.

Now you understand
Just why my head’s not bowed.   

I don’t shout or jump about
Or have to talk real loud.   

When you see me passing,
It ought to make you proud.

I say,
It’s in the click of my heels,   
The bend of my hair,   
the palm of my hand,   
The need for my care.

VIRTUAL WILLS

LEGAL UPDATE - Sept 2020

V I R T U A L W I L L S
The signing of Wills has been in situ for 183 years and the 31 January 2020 ushered in new rules that are now enshrined in law.

The order of signature remains the same...

1) Testator
2) First Witness
3) Second Witness

...but physical presence in the same room all at the same time has now taken a 21st century twist.

Zoom and virtual window signatures are now also acceptable. The 2020 Covid lockdown has seen very many changes not only to our lifestyle life including legal protocol and customs.

Beneficiaries and/or Executors should NOT be a witness a Will
